Introduction
This document outlines our standard Data Processing Addendum that forms part of our agreement with clients for website design services. Acceptance of the Data Processing Addendum is deemed to occur upon payment of any invoice or commencement of any project with us.
Roles and Responsibilities
1.1 Client Role
Our clients are the "data controller" for any personal data processed through their website.
1.2 Our Limited Role
Our role as Service Provider is limited to:
- Designing and implementing website content as directed by the client
- Setting up third-party forms or mailto links as requested by the client
- Providing design and development services only
1.3 Excluded Responsibilities
We are not responsible for:
- Hosting the website or associated infrastructure
- Processing or storing website visitor data
- Ongoing maintenance unless separately contracted
- The data protection compliance of third-party services embedded in the website
- The content or accuracy of privacy policies or cookie notices
Limited Data Processing
2.1 Visitor Data
We do not process website visitor personal data at any point.
2.2 Temporary Access
We may temporarily have access to a client's hosting account during initial setup but will not retain access credentials after project completion unless specifically agreed.
2.3 Third-Party Forms
Any third-party forms, including Tally, Jotform or another platform, embedded in the website are the responsibility of the client, who should have appropriate agreements with those providers.
Security Measures
We implement reasonable security measures during development, including:
- Secure handling of temporary access credentials
- Following web security best practices in design and development
- Secure transfer of website files
Project Completion
4.1 Temporary Files
Upon project completion, we delete temporary files containing client content.
4.2 Ongoing Responsibility
The client assumes full responsibility for ongoing website operation and data protection compliance.
Term and Termination
This Addendum remains in effect for the duration of the design services.
